Terms of Use

These Terms of Use (the "Terms") form an agreement between you and the Lang Shadow Development Team ("we," "our," or "us") and govern your use of the Lang Shadow mobile application and the langshadow.com website (together, the "App"). The App is distributed through the Apple App Store and Google Play.

By creating an account, signing in, or otherwise using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Your Account

You sign in with Google or Apple. You are responsible for keeping access to that account secure and for all activity that happens under your Lang Shadow account. Please tell us promptly at wisbi.dev@gmail.com if you believe your account has been used without your permission.

One account is for one person. Do not share, sell, or transfer your account, and do not create an account on behalf of someone else without their permission.

You may delete your account at any time from inside the App or through our account deletion page. Deleting your account does not automatically cancel a subscription billed by Apple or Google — see Section 4.

2. Licence to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own language learning. This licence does not transfer any ownership to you.

You agree not to:

• Copy, modify, translate, reverse engineer, decompile, or create derivative works from the App
• Resell, sublicense, rent, or otherwise commercialise the App or any content in it
• Use bots, scrapers, or automated tools to extract transcripts, audio, scores, or any other data from the App
• Interfere with, overload, or try to gain unauthorised access to our servers or other users' data
• Use the App to upload unlawful, abusive, hateful, or infringing material
• Circumvent usage limits, paywalls, or any security or rate-limiting measure

3. Your Content

"Your Content" means the voice recordings, text you type, saved words and sentences, notes, and other material you create in the App. You keep ownership of Your Content.

You grant us a worldwide, royalty-free licence to host, process, and transmit Your Content only so far as it is needed to operate the App for you — for example, sending a recording to our speech assessment provider to produce a pronunciation score, or storing a saved sentence so it appears on your device. We do not sell Your Content, and we do not publish it without your action.

Some features send Your Content to third-party processors (for example Microsoft Azure Speech, OpenAI, and Google Cloud) purely to generate a result and return it to you. How this data is handled is described in our Privacy Policy.

If you share something through a community feature in the App, you allow other users of the App to see it. Do not share anything you are not comfortable making visible to others.

4. Subscriptions, Billing, and Cancellation

Lang Shadow is free to use with daily limits. A paid subscription raises or removes those limits and unlocks additional features. Prices vary by country and are shown in your local currency in the App before you buy.

4.1 Auto-renewal

• Subscriptions are auto-renewable. Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.

4.2 Managing and cancelling

You manage and cancel subscriptions in your store account settings, not in the App: iOS — Settings → your name → Subscriptions; Android — Google Play → Profile → Payments & subscriptions → Subscriptions. Cancelling stops the next renewal; you keep access until the end of the period you already paid for.

4.3 Refunds

Purchases are processed by Apple and Google, so refunds are handled by them under their own policies. We cannot issue refunds for store purchases directly. If something went wrong, write to us at wisbi.dev@gmail.com and we will try to help.

4.4 Changes to plans and limits

We may change prices, free daily limits, or what is included in a plan. Changes to the price of a subscription you already hold take effect at the next renewal, and the stores will notify you and ask for consent where their rules require it. Free-tier limits may change at any time.

5. Third-Party Content

The App lets you practise on videos, shorts, and podcasts that belong to their creators and are played through official players and APIs, including YouTube. We do not own that content, we do not claim any right in it, and it stays subject to the terms of the platform that hosts it — including the YouTube Terms of Service. Content availability can change or disappear without notice when a creator edits, restricts, or removes it.

If you own content shown in the App and want it removed, contact us at wisbi.dev@gmail.com and we will remove it.

6. Automated Scoring and AI Features

Pronunciation scores, transcripts, translations, corrections, level estimates, and conversation practice are produced by automated systems. They are an aid to learning, not an assessment, certification, or professional advice. They can be wrong — background noise, accents, microphone quality, and model error all affect the result. Do not rely on them as proof of language ability for exams, visas, employment, or any other official purpose.

7. Our Intellectual Property

The App itself — its software, design, name, logo, curriculum, exercises, generated lesson material, and the selection and arrangement of content — belongs to the Lang Shadow Development Team and is protected by copyright and other laws. Nothing in these Terms transfers those rights to you.

8. Service Availability and Changes

We may add, change, suspend, or discontinue features at any time, and we may limit availability of the App in certain regions. We aim for the App to be available continuously but we do not promise uninterrupted or error-free service. Maintenance, third-party outages, and network problems can interrupt it.

9. Suspension and Termination

You may stop using the App at any time and delete your account. We may suspend or terminate your access if you breach these Terms, abuse the service, attempt fraud or chargebacks, or if we are required to do so by law. Where it is reasonable to do so, we will tell you why.

If we terminate your account for a breach of these Terms, you are not entitled to a refund for any unused part of a subscription period, except where the law or the store's policy requires one.

10. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements, that scores will be accurate, or that defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of or inability to use the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the twelve months before the event giving rise to the claim, or USD 50, whichever is greater.

12. Indemnity

You agree to indemnify and hold harmless the Lang Shadow Development Team from claims, damages, and reasonable costs arising out of your misuse of the App, your breach of these Terms, or your infringement of someone else's rights.

13. Apple App Store Terms

If you obtained the App from the Apple App Store, the following also applies:

• These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
• Your licence to use the App is limited to use on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing claims relating to the App, including product liability, legal compliance, or intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Google Play Terms

If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.

15. Changes to These Terms

We may update these Terms. When changes are material, we will update the "Last Updated" date and notify you in the App or by email before they take effect. Continuing to use the App after the changes take effect means you accept the updated Terms. If you do not accept them, stop using the App and delete your account.

16. Governing Law

These Terms are governed by the laws of Vietnam, without regard to conflict of law rules. Where you are a consumer, you keep the protection of any mandatory consumer law of the country you live in, and you may bring proceedings in its courts.

17. General

• If a provision of these Terms is found unenforceable, the rest stays in force and the unenforceable part is applied as closely as possible to its original intent.
• Our not enforcing a right at some point does not waive that right.
• These Terms, together with the Privacy Policy, are the entire agreement between you and us about the App.
• You may not assign these Terms; we may assign them as part of a merger, acquisition, or sale of assets.
